Judge Rules in Pugliese LAUSD Election Challenge
Los Angeles- Stating that he assumed the listing of Nury Martinez "....as an educator is false" for the March 3 election ballot, Superior Court Judge James Chalfant on Thursday went on to rule that reprinting ballots would be too costly, and refused to order the city clerk to change the wording. The city had argued that since some parts of the ballot had already been printed, it was too late to correct any errors that may have been made.
During the proceedings, the Judge suggested that Pugliese might pay for the reprinting himself.
Louis Pugliese, a long-time teacher, had complained to the city clerk in writing on November 10 to protest his opponent's ballot description as an educator, but was told by the city that they would not review the matter, and that a court ruling was his only option. Ms. Martinez is the mayor of the city of San Fernando.
Pugliese's attorney Philip Koebel argued that by not reviewing the accuracy of filing documents, the city should rightfully assume the costs for reprinting the ballots. In addressing the issue of how much it would cost to reprint the LAUSD district 6 ballots, Koebel said, "The cost of misleading the voters is incalculable."
